“Discrimination against hearing-impaired individuals due to lack of reasonable accommodations during public enterprise interview exams”

Human Rights Commission recommends the Minister of Health and Welfare to amend the ‘Welfare of Persons with Disabilities Act Enforcement Decree’

[Korea NGO News=Jung Sung-min Reporter] The National Human Rights Commission (hereinafter referred to as the Human Rights Commission) has determined that failing to provide reasonable accommodations to hearing-impaired individuals during public enterprise interview exams constitutes discrimination. In response, the Human Rights Commission has recommended that the Minister of Health and Welfare amend the ‘Welfare of Persons with Disabilities Act Enforcement Decree.’

  According to the Human Rights Commission on the 18th, complainant A, a hearing-impaired individual, passed the written test for the disabled category in the public recruitment of new employees at B Corporation (the company being complained about) in 2023. Subsequently, A requested accommodations such as a proxy for the interview scheduled for February 8, 2024, from B Corporation. However, B Corporation refused, leading A to file a complaint with the Human Rights Commission, stating that they had no choice but to give up the interview.

  Furthermore, it was pointed out that the decision on whether to provide accommodations for disabled individuals during the interview should not be determined based on the qualifications for disabled applicants (those capable of performing on-site duties such as customer safety management, facility maintenance, and repair). Therefore, the act of B Corporation not providing reasonable accommodations to the complainant, who has a hearing impairment during the interview, falls under the discrimination prohibited by Article 4, Paragraph 1, Item 3 and Article 10, Paragraph 1, Item 4 of the ‘Act on the Prohibition of Discrimination against Persons with Disabilities and Remedy for Rights.’
